Making A Purchase Please read these conditions of sale ("Agreement", "terms and conditions") carefully before ordering any goods from UkByPost ("we", "us" or "our") from the web-site ("Site"). By ordering any goods from this Site you, the buyer ("you" or "your") are deemed to have accepted these terms and conditions. If you do not accept this Agreement, you may not purchase any goods from this Site.

Nothing in this Agreement affects your statutory rights.

We may change the Agreement at any time, and in doing so it is your responsibility to check what alterations have been made. Your continued use of this Site, after any such changes, will constitute your acceptance of the changes to these terms and conditions. We may terminate, change or suspend any part of this Site, including any content, features or hours of availability at any time and at our sole discretion.

By placing an order you are deemed to have accepted these terms and conditions. All goods that appear for sale on this site are advertised as invitations to treat, and no offer of sale shall be implied. By placing an order with us you are offering to purchase the goods detailed in the order, which we may or may not accept at our sole discretion. After placing an order you will receive an e-mail notifying you that we have received your order. We will then notify you of our acceptance of your order by e-mail or fax once cleared payment has been received and goods dispatched.

In the event that a brand / quantity combination is unavailable or discontinued, we will act in the following manner. a) If an item is not available in the requested weight then we will attempt to supply a larger quantity of the same item type but in smaller weights, the total weight will either equal or exceed the original amount requested, or an appropriate refund will be given. b) If an item is not available in the requested brand we will email the customer offering an alternative brand of the same or greater value, an appropriate refund, or to hold the shipment until the item is in stock. If a customer has requested we delay dispatch until a brand is available we will hold onto the order for up to a maximum of 10 days, at which point we will contact the customer for further instructions.

All descriptions, weights and dimensions of any goods made available on this Site are those of the original manufacturers and are intended only to provide a general description of the goods. Accordingly, any such description shall not form part of this Agreement. The prices listed on this Site are our prices ruling at the time you submit your order. However, you accept that mistakes can be made when uploading prices onto the Site, or that prices may vary between when we display a price and when goods are purchased. Accordingly, we may validate your order before we accept it. Where the correct price is higher than the price displayed on your order we may contact you by e-mail to let you know the correct price and provide you with the opportunity to cancel your order.

All payments shall be made in pounds sterling (GBP). You may pay for any goods you order from this site using any credit or debit card that we accept from time to time. Payment may be made by our secure online ordering system, or by telephone/fax quoting your credit card number. You undertake that all the details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the products you are purchasing. Payment by cheque drawn on a UK bank account only will also be accepted, but will require 7 days clearance prior to dispatch. Payment of the whole of the price of the goods must be received by us before we can process your order and dispatch the goods to you. With each order that we deliver to you we shall deliver to you an invoice in respect of that order. At no time will we store your credit card details electronically.

You are responsible for the payment of any import duties, taxes and any other local charges levied in your country of residence. We have no control over these charges and cannot predict what they might be. You should contact your local customs office for further advice. You acknowledge that for any goods that you order from us, that you are over the legal age (if any) for the purchase of such items, and that you can legally purchase these products in your country of residence. Failure to comply with this may result in seizure of goods by customs officials, and in such a case, liability is yours, the buyer.

Deliveries will be made by our appointed carrier ("Carrier") at the address stipulated in your order and at the buyer's risk. It is your responsibility to ensure that someone is available to accept delivery. Any timescales given for delivery are for guidance only and no liability will be accepted for any delays. Any stipulated period of time for delivery shall start from the date on which we accept your order. Any and all risk passes to the customer once your order has been collected by the Carrier. After seeking your approval we may ship your order in multiple installments as required. From time to time we may offer discounts or free delivery. These offers are available at our discretion and will not include products that may require special handling or packaging.

If you are not satisfied with the goods contained in your order, or any part of your order or wish to cancel this Agreement for any reason you have the legal right to do so within seven (7) working days from the date following the date of delivery of the goods to you. We cannot accept returns for perishable goods or personalised goods unless damaged or faulty. Prior to returning the goods you must obtain a returns number from us by email first. Then return the goods in their original condition, undamaged and not been tampered with in any way. The goods must be securely wrapped and with all original packaging, including the packing slip and an indication of the reason why the goods are being returned. In any event you will be responsible for the cost of returning the goods. We will credit your credit or debit card with the full purchase price of the goods returned as soon as is reasonably practicable but in any event no later than 30 days from the date of receipt of notification of cancellation and we may make a charge for the direct costs of recovering the goods supplied (excluding substitute goods or goods returned due to damage or error) if you do not return them in accordance with the above conditions.

Nothing in this clause shall limit or exclude our liability for: (a) death or personal injury arising from our negligence; (b) fraudulent misrepresentation; or (c) any warranty implied by section 12, 13 or 14 of the Sale of Goods Act 1979. You agree that we shall not in any circumstances (including if we have been negligent) be liable to you for: (a) any indirect or consequential loss or damage at all; or (b) any loss of business, capital, profit, reputation or goodwill, arising out of or in connection with this Agreement or its subject matter. Subject to the clause above to which no limit applies to such liability, you shall not make any claim against us to the extent that, as a result of any such claim, our aggregate liability in respect of all causes of action arising out of or in connection with this Agreement or its subject matter (whether for breach of contract, in negligence or any other tort, under statute or otherwise at all), including for the loss or damage to goods whilst in transit, would exceed an amount equal to the value of the goods delivered to you under this Agreement. Subject to the clause above, we shall not be liable for any claim arising under this Agreement unless you give us written notice of the claim within 6 months of becoming aware of the circumstances giving rise to the claim or, if earlier, 6 months from the time you ought reasonably to have become aware of such circumstances. Except as expressly provided in this Agreement, we exclude all representations, conditions and warranties whether express or implied (by statute or otherwise) to the fullest extent permitted by law.

We shall not be liable to you for any delay in, or failure of, performance of our obligations under this Agreement arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to deliver) and industrial action.

We cannot guarantee that our Site will be available 100% of the time, and because of this any loss, financial or otherwise, will not be our responsibility. Loss or damage caused by our Site or e-mail system, through error or virus, shall not be our responsibility, and no compensation shall be offered.

Each delivery shall be considered a separate transaction and the failure of any one delivery shall not affect the due performance of the contract as regards other deliveries.

This Agreement may not be amended, modified, varied or supplemented except in writing signed by or on behalf of each party. If any part of this Agreement is found to be void or unenforceable, it will be severed from the rest of this Agreement so that it is ineffective to the extent that it shall not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. Except as otherwise expressly provided, this Agreement shall end when we have delivered your order to the Carrier.

Third Party Rights: Nothing contained on this Site confers on any third party and benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.

This contract shall be construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Courts.

We accept credit card payment. If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to your own currency. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. You may send your credit card information via phone, fax, post mail or over the Internet.

Shipping And Handling We offer discounted shipping. We currently use Parcelforce for most of our worldwide deliveries. Most EU Parcelforce delvieries will be made using Parcelforce Euro 48, and will usually be delivered within 2 working days of dispatch. For the rest of the world we typically use Parcelforce International Scheduled service. This method will usually deliver within 5 to 6 working days from dispatch.

As our deliveries are discounted to our customers you can be sure of getting good overall value.

You will find that deliveries are more cost effective the more they weigh. As a rule of thumb, the more you place in a single order, the cheaper the delivery becomes per Kilogramme weight.

Delivery Schedule We will endeavour to dispatch you order as soon as possible. We will normally dispatch your order to you in three working days. During peak periods this may take longer, but we will get to you as quickly as we can!
Credit Card Security We use Pay Pal  to process our credit card orders.
